Attorney says Maynard recusal could change outcome of Massey, Harman case

Chief Justice Spike Maynard today (Friday) recused himself from a court case involving Massey Energy.  

In November, Maynard voted with the majority in a 3 – 2 decision in favor of Massey Energy that overturned a $50 million verdict. With interest, damages had climbed to $76 million by the time it reached the Supreme Court.

A motion for the Supreme Court to rehear the case is pending. But the attorney for the plaintiff says Maynard’s recusal today could lead to the original verdict against Massey being upheld. Anna Sale reports.
